Theories of persistence are often motivated on the grounds that they can account for or solve certain problems that accompany persistence as a metaphysical problem. These problems are what I will call the problems of persistence: change, cohabitation, and vagueness. In this paper, I claim that any theory of persistence should be able to account for these problems. Any theory of persistence which fails to do so should be rejected or, at the very least, be seen as unsatisfactory. Kristie Miller (...) introduces a possible contender, terdurantism, which is a “non-perdurantist four-dimensionalism,” as she puts it. This view is attractive because it avoids the usual objections raised against its rivals: perdurantism and endurantism. Miller and I both ultimately argue against the plausibility of terdurantism as a theory of persistence, but our motivations differ. Miller’s argument is based on the presumption that any theory of persistence which is non-perdurantist ultimately fails. She argues that temporal parts are needed in any account of persistence. My argument is based on the “problem-solving” capacity or the ability of the theory to account for the persistence problems. I will argue that terdurantism is not a plausible theory of persistence since it fails to give a viable account of the three problems. By showing the importance of accounting for the three problems — and how a terdurantist position fails to accomplish this — I hope to have convinced the reader that not only is terdurantism an unattractive persistence theory, but any plausible theory of persistence ought to account for the problems. This commentary on Plato's Philebus reconciles a close analysis of the text with a new interpretation of the dialogue. In Philebum focuses on the overarching metaphysical and cosmological coherency of the dialogue rather than its ethical import. This interpretation contrasts with the more common segmented philological analysis of this most evocative of Platonic dialogues. Plato's late ontology and theory of an immanent Good portray a very different philosophical terrain than that of the transcendental visions of the Good found in other (...) dialogues. The final chapter of In Philebum, entitled "The Life of the Speculative Philosopher," extends this analysis of the dialogue to contemporary speculative philosophy. Based on Plato's portrayal of a fourfold onto-cosmology and of the Good as measurability, proportionality, and intelligence, In Philebum makes connections between the doctrine of measured order-relations, triadicity, quadratic structure, and self-explanation that figure predominantly in contemporary speculative philosophy. It is intended for a broader audience of readers of Plato as well as for graduate students and commentators on Plato. While the idea of worker-owned cooperatives is centuries-old, the network of over 300 such enterprises in the Basque region of Spain and founded upon Catholic social justice teachings, is the most successful and impressive in history. The central claim of this paper is that the worker-owned, Mondragon cooperatives demonstrate not only how economic institutions can be structured so as to promote the common good but also how participation in them can engender a concern for the common good among individual participants (...) in those institutions, which spills over into their broader participation as citizens in the larger community. The paper advances this thesis by, first, providing a brief history of the Mondragon cooperatives, from their founding in the 1950s by Father Jose Arizmendiarrieta, the parish priest in the village of Mondragon, trained in economics. Second, it outlines the central principles of Catholic social justice teachings regarding economy that form the foundation for the Mondragon cooperatives and how those teachings have been institutionalized in the cooperatives’ democratic managerial practices and their creative financial structures. While Father Arizmendiarrieta drew mainly from Pope Leo XIII’s Rerum Novarum, this paper shows how Mondragon’s policies and practices are also in keeping with later Church teachings, as put forward especially by Popes John Paul II, Benedict XVI, and Francis I. Third, the paper contrasts the understanding of the common good in Catholic social teachings and the Mondragon cooperatives, on the one hand, to the notion of the common good found in mainstream classical and neoclassical economics. The latter sees society as merely the sum of its individual members and hence the common good as but the sum of individual goods, or aggregate utility. The former, by contrast, sees society as a living organism, the whole of which is greater than the sum of its parts, and hence it understands the common good as greater than the sum of individual goods, but also including the organic relationships among individuals. Fourth, the paper describes how participation in the cooperatives engenders, cultivates, and deepens worker-members’ sense and understanding of the common good and their commitment to it. (shrink)

Sayre; xxiii & 292 pp. Notre Dame: University of Notre Dame Press, 1995, $34.95.One of the best known paradoxes in the Platonic corpus occurs in the Seventh Letter (341), when Plato says that he has never written about the problems which concern him and never will. His reason: “This knowledge can never (...) be put into words like other subjects; but is generated by living with the matter itself and from many conversations (ek polle\s sunousias). Then like a flashing light when a fire is kindled, it is born in the soul and nourishes itself.” Why would the most gifted philosophical writer in history say that when it comes to goodness, beauty, or justice, language is an inadequate medium in which to convey truth?One answer is that Plato had an esoteric doctrine that he divulged to a few close associates but did not express in the dialogues. 1 The crux of the esotericist position is that Plato’s objection is not to language as such but to written language in particular. A more satisfying answer is offered by Kenneth M. Sayre in this recent book. According to Sayre, Plato wrote dialogues to allow the reader to have conversation (sunousia) with the author “in an indirect manner” and to facilitate the reader’s own discovery of truth. In other words, the dialogues are surrogates for the sort of discussions Plato shared with Socrates “in hopes of producing a similar effect in the mind of the reader.” [End Page 167]If Sayre is right, the problem discussed in the Seventh Letter is not limited to written communication but involves “logoi in whatever form we might identify them today” (p. 159). Sayre enlarges on this insight by claiming (p. 18) that for Plato “philosophic knowledge is not awareness of the truth of propositions” but “discernment of some aspect of reality.” 2 Nor is this view limited to the Seventh Letter; Sayre finds it expressed in dialogues ranging from the Meno to the Statesman. Although I have problems with some of the details of this interpretation, it is noteworthy that the Seventh Letter (342a) does claim its epistemology is not new and “has been expounded many times before.” 3The title of Sayre’s book is taken from a famous passage in the Phaedrus (276), where Socrates says that while written language gives the appearance of finality and inviolability, it is an image (eido\lon) of living speech, by which he means words that can defend themselves and are accompanied by knowledge. But as Sayre points out, the passage also carves out a role for written speech by claiming that it is legitimate for the dialectician to plant seeds in “a literary garden” to assist memory in later years and to help others who “wish to walk in the same path.” In fact, the passage tells us that the dialectician will select a soul of the right type and take pleasure in watching the seeds grow and mature. In keeping with Plato’s metaphor, Sayre organizes his chapters into functions associated with gardening: some dialogues prepare the ground, others sow the seeds, train the shoots, or allow us to reap the fruit. The book ends with an appendix on how to read a specific dialogue, the Theaetetus, in a way that emphasizes indirect or imagined conversation. This chapter develops and defends an account of reason: to reason is to scrutinize one’s attitudes by consulting the perspectives of other persons. The principal attraction of this account is its ability to vindicate the unique of authority of reason. The chapter argues that this conception entails that reasoning is a robustly social endeavor—that it is, in the first instance, something we do with other people. It is further argued that such social endeavors presuppose mutual respect on the part of (...) those participating in them. My aesthetic judgements seem to make claims on you. While some popular accounts of aesthetic normativity say that the force of these claims is third-personal, I argue that it is actually second-personal. This point may sound like a bland technicality, but it points to a novel idea about what aesthetic judgements ultimately are and what they do. It suggests, in particular, that aesthetic judgements are motions in the collective legislation of the nature of aesthetic activity. This conception is recommended by (...) its ability to explain some important but otherwise recondite features of aesthetic practice and, more importantly, by allowing us to ground the normativity of aesthetic judgement in the familiar normativity of practice. David Hume wrote that Berkeley's arguments `admit of no answer but produce no conviction'. This book aims at the kind of understanding of Berkeley's philosophy that comes from seeing how we ourselves might be brought to embrace it. The extant literature on comparative Corporate Social Responsibility often assumes functioning and enabling institutional arrangements, such as strong government, market and civil society, as a necessary condition for responsible business practices. Setting aside this dominant assumption and drawing insights from a case study of Fidelity Bank, Nigeria, we explore why and how firms still pursue and enact responsible business practices in what could be described as challenging and non-enabling institutional contexts for CSR. Our findings suggest that responsible business practices in (...) such contexts are often anchored on some CSR adaptive mechanisms. These mechanisms uniquely complement themselves and inform CSR strategies. The CSR adaptive mechanisms and strategies, in combination and in complementarity, then act as an institutional buffer, which enables firms to successfully engage in responsible practices irrespective of their weak institutional settings. We leverage this understanding to contribute to CSR in developing economies, often characterised by challenging and non-enabling institutional contexts. What is the nature of law and what is the best way to discover it? This book argues that law is best understood in terms of the social functions it performs wherever it is found in human society. In order to support this claim, law is explained as a kind of institution and as a kind of artefact. To say that it is an institution is to say that it is designed for creating and conferring special statuses to people so (...) as to alter their rights and responsibilities toward each other. To say that it is an artefact is to say that it is a tool of human creation that is designed to signal its usability to people who interact with it. This picture of law's nature is marshalled to critique theories of law that see it mainly as a product of reason or morality, understanding those theories via their conceptions of law's function. It is also used to argue against those legal positivists who see law's functions as relatively minor aspects of its nature. -/- This method of conceptualizing law's nature helps us to explain how the law, understood as social facts, can make normative demands upon us. It also recommends a methodology for understanding law that combines elements of conceptual analysis with empirical research for uncovering the purposes to which diverse peoples put their legal activities. Antonín J. Liehm (1924–2020) was a prominent Czechoslovak journalist and cultural critic, who played a significant role in the cultural liberalization during the 1960s as editor of the literary magazine Literární noviny. Following the Soviet invasion of 1968, Liehm went into exile and joined the struggle to liberate his homeland. He was a major contributor to the exile magazine Listy, established in Rome in the early 1970s by Jiří Pelikán. After some years of teaching at universities in the United States, (...) Liehm moved to Paris where, besides teaching at a number of institutions of higher learning, he founded the cultural magazine, Lettre internationale. In 2010, I met Liehm for the first time and we remained in close contact until his death ten years later. In this article I present Liehm’s most significant achievements and my own personal recollections of him as a public intellectual. (shrink)

In this paper, I revisit a problem in immunology and molecular genetics that I had first tried to understand some philosophical implications of over twenty years ago. At that time, some immunologists such as Mel Cohn at the Salk Institute, referred to it as the GOD problem, which was the acronym forGeneratorOfDiversity (also see Cohn's more recent discussion in his 1994, 41-48). In the early 1970s there were three or four different theories that had been proposed to account for the (...) way in which antibody diversity is generated and considerable argument among the proponents of the different approaches to the problem (see Cohn, 1994). In 1971-72 I attempted to assess the strengths and weaknesses of the competing theories of antibody diversity from the perspective of a “logic of comparative theory evaluation” that had seemed to work reasonably well in physics (Schaffner, 1970), and I drafted an essay that ultimately sided with one of those theories (somatic mutation). The essence of temporal universe creation is that any analytical solution has to comply with the boundary condition of our universe; dimensionality and causality constraints. The essence of this book is to show that everything has a price within our temporal (t > 0) universe; energy and time.

Berkeley's philosophy is meant to be a defense of commonsense. However, Berkeley's claim that the ultimate constituents of physical reality are fleeting, causally passive ideas appears to be radically at odds with commonsense. In particular, such a theory seems unable to account for the robust structure which commonsense (and Newtonian physics) takes the world to exhibit. The problem of structure, as I understand it, includes the problem of how qualities can be grouped by their co-occurrence in a single enduring object (...) and how these enduring objects can bear spatiotemporal, causal, and other relations to one another. I argue that Berkeley's solution to these problems lies in his views about language. At one level, human language allows us to exploit patterns in our perceptions to construct a highly structured representation of the physical world which allows us to make accurate predictions at minimal cognitive expense. At a deeper level, these patterns occur in perception because our perceptions themselves form a language in which God speaks to us. (shrink)

The primary aim of this chapter is to show that several missteps made by others in in their thinking about law as an artefact are due to misconceptions about the role of intentions in understanding law as an artefact. I first briefly recap my own contention that law is a genre of institutionalized abstract artefacts (put forth in The Functions of Law (OUP 2016) and subsequent papers), mostly following Searle’s understanding of institutions and Thomasson’s understanding of public artefacts. I highlight (...) the central place that this theory affords law’s functions, without requiring the theorist to say that possession or performance of the function is either necessary or sufficient for inclusion in the class of law. Some of the most common misunderstandings are exemplified in Brian Leiter’s paper ‘Legal Positivism about the Artifact Law’. He thinks that holding an intentionalist view of artefacts commits the theorist to privileging drafters’ intentions when interpreting law. (It doesn’t.) He also has confusions about the differences between artefact tokens and artefact types leading him to a problematically broad understanding of artefacts. Another problem can be seen in thinking that functional understandings of artefacts are vulnerable to the same problems that arise in functional explanations for biological systems. I go on to consider the work of Luka Burazin and Corrado Roversi, addressing worries that making intentionality central to artefacts implies too much conscious thought is required to make one, noting that several theories of intentionality do not require conscious thought in the execution of intentional action. While those who think a central place for intentionality threatens to leave us unable to explain customary law, this can be dealt with by noting the important distinction between customary rules and customary laws (where the latter requires a decision to enlist public aid in redressing violations). I claim that authors’ intentions are communicated requests for the artefacts’ audiences to see the artefacts as members of their putative kinds. Finally, I address the question of whether or not legal systems are themselves artefacts and institutions, given that they may or may not have been intentionally created. An early lawgiver might have created a legal system by accident in the process of handing down the first laws. I raise the possibility that we might want to impute intentionality to necessary by-products of artefact creation, seeing those by-products as artefacts as well. (shrink)

Our approach in this response is as folIows. In § I, we try to identify accurately Boatright’s central claims-both about Goodpaster’s original paper and about matters of substance independent of that paper. In § 2 and 3, we discuss the plausibility of those claims, first from a legal point of view and then from a moral point of view. Finally, in § 4, we defend the concept of paradox (and, in particular, the Stakeholder Paradox) as a limitation on practical reason (...) which is not necessarily to be lamented. In fact, we believe, some paradoxes are better preserved from rather than guided toward resolution. (shrink)

The argument from contingency for the existence of God is best understood as a request for an explanation of the total sequence of causes and effects in the universe (‘History’ for short). Many puzzles about how there could be such an explanation arise from the assumption that God is being introduced as one more cause prepended to the sequence of causes that (allegedly) needed explaining. In response to this difficulty, this chapter defends three theses. First, it argues that, if the (...) argument from contingency is to succeed, the explanation of History in terms of God must not be a causal explanation; second, that a particular hypothesis about God’s relation to History—that God is what I call the foundational ground of History—is intelligible and explanatory; third and finally, that the explanatory advantages of this hypothesis cannot be had within the confines of naturalism. Anne Conway’s Principles of the Most Ancient and Modern Philosophy, first published in 1690, is probably the most ambitious contribution to early modern metaphysics by a woman writing in the English language. This beautifully prepared edition makes Conway’s treatise available to twentieth-century readers in an accessible English translation of the 1690 Latin text—itself a translation of an original English manuscript that has long been lost.

Each author first presents his own side, and then they interact through two rounds of objections and replies. Pedagogical features include standard form arguments, section summaries, bolded key terms and principles, a glossary, and annotated reading lists.
